A Man Cannot Give What He Does Not Have
Literally, meaning, "No one can give what they do not have..." This is sometimes called the nemo dat rule, that states, "the purchase of a possession from someone who has no ownership right to it also denies the purchaser any ownership title.."
In view of this Latin Maxim, Is it right to say Aiyedatiwa's controversial certificate issues have been overtaken by events hence the effluxion of time to raise eyebrows. But crime doesn't run against the state? In other words, no statute of limitation hence a suspect not tried could yet be arraigned in court. What plays out in the likely instance that the suspect, initially, by virtue of S308 of 1999 Constitution had at sometimes in 2020 participated in an election, won the election as a running mate and thereafter sworn-in as Deputy Governor.
Evidently, S308 is copiously protecting alleged offences bothering on corruption and it seems to be the most controversial clause in the Constitution of the Federal Republic Nigeria. That, a suspect who prima facie commits an offence including stealing, obvious corrupt practice and felonies of all manner is shielded by this provision. Unfortunately, this preserves the interest of Executive Power. Including, but not limited to State Governor/Deputy & President/Vice President. It, is, of course, the most debatable topic in Nigeria today. The continued retention or, removal of Immunity clause enshrined in the 1999 Constitution of the Federal Republic of Nigeria.
To the crux, except this clause is thoroughly considered, it might continue to protect all manner of dangerous offences including murder.
For Ondo State Election, Police Report & Governor Aiyedatiwa. The clarification as to alleged certificate forgery & perjury is not only important but very useful in the circumstance. There's a precedent that must arise from the decision of INEC if found culpable, the choice of the good people of Ondo State and our famous reputation overtime to not only pride ourselves as bastion of integrity, honesty and above all intellect but also fastidious and deliberate in our choices. Ondo State had never made a choice of Governor in error since transition with the like of Chief Adebayo Adefarati, Olusegun Agagu PhD, Dr. Rahman Mimiko until the late Governor Oluwarotimi Akeredolu, SAN.
Obviously, the coming days will be most interesting. But if no man ever test a matter in court, it will remain but a mere INVESTIGATION. In other words, an investigation cannot be deemed as Law. However, there's a minimum standard that approves participatory politics and sanctioned by INEC, the electoral umpire. Ordinarily, issues of this nature ought to be tested in court not minding the complex nature, and if not litigated, whether an investigatory document could yet suffice as a satisfactory limitation. Will INEC take decision on mere alleged misrepresentation, forgery & perjury even though investigated by Police Force. Will this construe anything meaningful before the umpire. Not too sure! A court must rule!
Other issues including whether or, not it was proper or, right for the late Arakunrin Oluwarotimi Akeredolu Aketi, SAN to have picked a controversial running mate among other questions would no doubt suffice in the coming days. Until then, please grab popcorn and do sobo drink.
Sometimes, it feels really nice to watch political drama unfolding with major stakeholders. Will the people of Ondo State who made Education their capital sacrifice other competing interests whose resume(CV) are unquestionable and who had gone through Life's processes to attain good standing in various walk of life ; verifiable records of service and stewardship. This is not limited to Dr. Jimoh Ibrahim OFR who prides nine certificates, Olusola Alexander Oke a senior advocate of Nigeria, John Akinmurele a security expert, Hon.Odimayo a chartered accountant and business mogul, Mr. Wale Akinterinwa another chartered accountant & Financial expert among others including, the famous Physician & Medical Doctor. Akintelure...(the list is endless and in no more particular order were enlisted).
Please, pardon me if your names were not mentioned as an aspirant gunning the number one seat in Ondo State. It might be an oversight or, ignorance. I can always update the list whenever the need arises.
This moment, however timeously expected is not only deserving momentary silence but also imminently seeking our communal rethink on the prospect and prosperity of Ondo State. It also requires a deep sober reflection. In the end, I am optimistic that Ondo State will triumph all mendacious tendencies. It cannot be business as usual. We deserve the best!
Ondo State remains our place of pride devoid of sentiments, lack, poverty, hunger, greed and megalomaniac tendencies.
