Reminiscence to the act displayed by a political group in Obafemi-Owode Local Government aimed at OOLG All Progressives Congress Chairmanship Candidate, Hon Ogunsola 'Lanrewaju Adesina that he is unqualified to be the flag bearer of APC for OOLG in the forthcoming Local Government Election having allegedly presented a forged result, same though has been struck out by His Lordship, Justice Akinyemi of High Court 4.
Justice Akinyemi according to him, stated that the action filed by the Claimant is belated, having not filed within the time provided by the Constitution.
Expressed further in the judgement of the court is the provision of Section 285(9) of the 1999 Constitution as amended, which provides for the limitation of time within which a preelection matter could be filed. The provision of the aforementioned section of the Constitution makes it mandatory for any aggrieved person to file such suit within 14 days from the day the event complained about happened. From the process filed by the Claimant, it was observed by the court that the event complained about happened on the 24th of May, 2021, while the Claimant filed on the 28th of June, 2021, which apparent is outside the time permitted by law: hence renders the action dead on arrival.
